Discussing prenuptial agreements on BBC Radio Gloucestershire

In the event of a divorce, a prenuptial agreement can be useful to help smoothen the division of finances and assets between you and your partner.

In March, our divorce & family lawyer, Kristie Silsby, joined Nicky Price on BBC Radio Gloucestershire to discuss all things ‘prenups’.

Prenups are bespoke documents that protect the finances and assets that you’ve worked hard for and want to ringfence before getting married or entering a civil partnership. In the unwanted event of a divorce, these set out in advance what you and your partner intend to do should it ever come to dividing things during the breakdown of a relationship.

Albeit not the most romantic of topics to discuss before a wedding, prenuptial agreements can be a very sensible consideration to have, particularly for business owners, those with property or others who are remarrying, for example.

As part of an interview live on BBC Radio Gloucestershire, Kristie explained in detail – amongst other things – the processes and timescales involved in the arrangement of prenups, who they could be useful for and how they are relied upon if required. As well as offering insight into the conversations had with clients, our family law expert also touched upon cohabitation agreements and how they could be beneficial for couples who aren’t married or in a civil partnership.

Coinciding with a recent YouGov poll – whereby 42% of British people viewed prenups to be a good idea compared to just 13% who viewed them in a negative light – BBC Radio Gloucestershire sought the opinions of locals, and seemingly found the overall majority of those interviewed were in agreement that protecting finances and assets in this way was a sensible thing to do.

The importance of ensuring these documents are handled correctly is paramount. If a prenup, for instance, isn’t carefully and accurately drafted by a professional, the probability of encountering unnecessary complex and emotional problems during a relationship breakdown is signifcantly increased.
